INTRODUCTION

We may revise these terms and conditions at any time without advice. You should check this Website from time to time to review our current terms and conditions, because you are bound by them. Certain provisions of these terms and conditions may be superseded by legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

WEB SALES

You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.

Our acceptance of an order takes place when we dispatch the order. We will send you a despatch confirmation by email. When we despatch the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order. Please note that many of our products are made to order, so lead-times may be between 1 week and 4 weeks.

We may refuse to accept an order:

(a) where goods are not available;

(b) where we cannot obtain authorisation for your payment;

(c) if there has been a pricing or product description error;

ACCOUNT SALES

Invoice sales are considered been placed with written/verbal confirmation at the time of ordering.  As part of our sales process you will be given the opportunity to check your order and to correct any errors on the invoice that you will be sent.  Upon payment of the deposit element (noted in the payment terms), you are deemed to have accepted the details, specifications and price of the items listed, together with agreement of the payment terms.  The final balance pertaining to your order is due strictly within the terms and conditions stated upon your invoice.  Failure to remit your balance by the due date will negate all warranty on the goods stated on the invoice.

Special items manufactured for you are not returnable.  Other items which are standard product items can be returned in original packaging, complying with our cancellations and returns policy noted within this policy.

PRICING

Our prices do include VAT.  Parify is registered for VAT in the UK. Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.

CANCELLATION AND RETURNS POLICY

If you wish to cancel your order:

(a) you can notify us by email to sales@parify.co.uk before we have dispatched the goods to you; or

(b) where goods have already been dispatched to you, by returning goods to us in accordance with below.

All Items must be returned in their original packaging and in re-saleable condition. Any items that have been fitted, test fitted or damaged will be rejected for a refund. Once the item(s) have been received and confirmed in re-saleable condition the refund will be processed. Refunds can take as long as 10 working days to show back in to your account. The costs of returning goods to us shall be borne by you, as shall the initial cost of postage and packaging you were charged. Upon receipt of the goods we will give you a full refund of the amount paid or an exchange credit as required.

The rights to return the goods to us as referred to above will not apply in the following circumstances:

In the event that the product has been used

they are not in their original undamaged packaging

Damage is evident from the use of Incorrect Transformers/Drivers

Damage from installation by unqualified technicians

 The use of domestic lamps in commercial premises.

Cost of initial shipping and return shipping will be at your cost.

Any re-stocking (should we choose to accept returns after the 7-day period, will be subject to a 30% restocking charge)

Bespoke items and any bespoke order are non-returnable under any circumstance other than catastrophic failure rendering the item un-useable, excluding clause 4 B & C (above)

You are permitted to print and download extracts from this Website for your own use if you adhere to the following:

(a) no documents or related graphics on this Website are modified in any way;

(b) no graphics on the Parify website are used separately from accompanying text; and

(c) any of our copyright and trade mark notices and this permission notice appear in all copies.

Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by us or our licensors. For the purposes of these terms and conditions, any use of extracts from this Website other than in accordance with the above for any purpose is prohibited. If you breach any of the terms in these terms and conditions, your permission to use this Website automatically terminates and you must immediately destroy any downloaded or printed extracts from this Website. While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period. It is prohibited to access the Website from territories where its contents are illegal or unlawful. ACCESSING AND UPDATING

You are entitled to see the information held about you and you may ask us to make any necessary changes to ensure that it is accurate and kept up to date. If you wish to do this, please contact us at info@parify.co.uk. We are entitled by law to charge a fee of £10 to meet our costs in providing you with details of the information we hold about you.

CHANGES TO OUR PRIVACY POLICY

Any changes to our privacy policy in the future will be posted to the website and, where appropriate, through e-mail notification.

Electrical and Installation:

Quotations based on the assumption that the current electrical installation complies with regulations BS 7671: 2008 + Amendment 3: 2015 and that the circuits are capable of taking the planned alterations. Any necessary alterations to the current electrical installation will incur an additional cost. Should we upon arrival find that the electrical system of the store is substandard and does not conform to current specifications, additional costs will be incurred to make it safe and conform to legal standards.

All work areas are to be clear of merchandise prior to commencement of work, any time delay will incur an additional charge. Any alterations to the agreed specification, may incur an additional charge.

Lighting Design:

Under all circumstances, the lighting design produced by Parify is our best interpretation of your requirements given the information provided.  We shall give the client the very best consultancy and expertise that we can, however, the client is required, prior to paying a deposit and therefore agreeing to a commercial contract, to assure themselves that you they are happy and 100% in agreement to what we have proposed.

Furniture and Shop-fitting:

Parify Retail Design, and its parent and/or sister company shall in all instances, provide you with our best interpretation of your requirement given the information required.  Should any information pertaining to the manufacture of the units (colour, specifics, glass types, construction methods, lighting, logos, RAL codes, material specifications, etc) be omitted in the invoice, it is the clients responsibility to advise of this prior to paying the deposit and therefore agreeing to the contract AS STATED ON THE INVOICE.  Any further changes in specification will need to be made in writing to Progressive Display PRIOR to commencement of manufacture.

Any changes to specification may attribute an additional cost which will be added to the final balance of the projects invoice. It is the client’s responsibility to advise on colour, materials, location, construction method (other than our standard construction), changes to standard lighting, logos, glass types and any other fundamental material, finish or hardware types and advise Progressive Display accordingly.  No adjustments in cost for failure to inform any changes will be permitted.

Any cost implications resulting from return visits, re-manufacture, re-supply and or any adjustments pertaining to the above, shall be covered by the client unless specifically communicated as instructed.

WARRANTY

Unless otherwise stated, all products manufactured by Parify (unless stated) are subject to our 3-year manufacturer’s warranty. This warranty does not apply to damage or failure to perform arising as a result of any Acts of God or from any abuse, installation buy unqualified technicians, misuse, abnormal use or use in violation of any applicable standard, code or instructions for use including without limitation those contained in the latest safety, industry and/or electrical standards for the relevant region(s).

The warranty solely relates to the light unit and driver.  When a claim is made, Parify shall deliver the replacement unit upon acceptance of your claim and arrange collection of the damaged unit.  Parify will not be liable for any fitting, removal, interruption to business costs arising from the failure of a lamp or driver.

Furthermore, the warranty applies products installed in environments for which they are designed to operate in, such as shops, shopping centres, airports, retail outlets, concessions, etc, and does not apply to products used externally in extreme cold, or hot environments such as hot rooms, in saunas, bakeries, kitchens etc.  Adequate cooling and airspace above the lamps and drivers are a pre-requisite to installing Parify’s high performance range of lights, should they be used in circumstances where there is insufficient space for the luminaire to cool, the warranty shall be invalid. Sufficient space is deemed to be 150mm void above the luminaire.

Payments must be made on or before the due date as specified on your invoice. Failure to pay by the due date will invalidate all product and service warranties.

Any other products sold by Parify, which are not manufactured in house, will be sold with the manufacturers guarantee whatever that may be.

Further Exclusions:

using our dimmable LED luminaires with anything other than a recommended trailing edge dimmer switch.

using our low voltage LED bulbs with anything other than a recommended LED driver.

using our luminaires in hot or cold environments <0 degrees and >35 degrees.

Using our luminaires and drivers in conditions of high humidity or in the presence of water.
